Divorce is never easy, but things only get worse when you have a divorce lawyer that doesn’t understand your goals or simply views your case as just “another file.” Your divorce lawyer needs to be someone you trust, confide in, and interact with for no less than 2 months and sometimes for a year or longer, especially if your Texas Divorce involves children. Sometimes, you may need to modify the provisions of your divorce decree, such as child custody or child support provision- and this could result in you using the same attorney again, perhaps years later. The point is, your Divorce Lawyer needs to be experienced, someone you trust, and above all someone that you feel actually listens and understands your goals and who will seek to efficiently achieve those goals without excessive expense or increasing the marital conflict.
You probably won’t have to look too hard to find someone that has a horror story about the Divorce Lawyer they hired to represent them. Often times, these stories involve an inexperienced Divorce Attorney that either didn’t understand their client’s goals or, even worse, just didn’t put their best efforts into the case. This is why it is important that you hire an attorney you are comfortable with which may require interviewing several Divorce Lawyers before actually retaining one.
The Divorce Lawyers at Nick Davis Law will meet with you, listen to the circumstances of your divorce, provide an overview of the divorce process in Texas, and discuss your legal options moving forward. Our Divorce Lawyers offer a Free Case Evaluation as well as Payment plans and serve all of Montgomery, Waller, Walker, Grimes, Harris, Brazos, Washington and surrounding counties from locations in The Woodlands | Magnolia | Conroe, TX and Bryan | College Station, Texas.
Schedule a Free Case Evaluation by phone or virtual conference at (936) 262-7474 if you are in need of a Divorce Lawyer for a case in Montgomery, Harris, Grimes, Waller, Walker, Brazos, Washington & Surrounding Texas Counties.
The Uncontested Vs. Contested Divorce
In most cases, the court will let individuals pursue a divorce on their own terms. That is, the court will allow people in a divorce to make decisions concerning property division, child custody, child support, debt division and other necessary elements. However, the catch is, both parties must agree to all provisions in the divorce documents, or the case will be a contested case.
If you and your spouse are fortunate enough to complete an Uncontested Divorce you will save a significant amount of time, money, and emotional stress. Depending upon the complex nature of the marital estate and child custody issues, an uncontested divorce can be extremely affordable (often at a low flat fee) and finalized in approximately 60 days.
When a case is contested, however, the court must get involved and make rulings on the terms of the divorce based on the evidence presented. In between the filing of the case and a final trial, there can be numerous hearings, discovery proceedings, and most likely a mediation. All together the process can take well over a year to complete and cost tens of thousands of dollars. Making matters worse, if you do not have an experienced Divorce Lawyer, or more importantly, a dedicated Family Law attorney that will actually thoroughly prepare and fight for you, there is a substantial risk that the court will make an unfavorable ruling which can determinately effect you and your children for many years, if not indefinitely.
The Divorce Lawyers at Nick Davis Law Firm will guide you through the Texas divorce process and fight to protect your interest in your children and property and vigorously prepare for and pursue a favorable ruling from the court.

Get an experienced Divorce Lawyer in The Woodlands | Magnolia | Conroe, TX and Bryan | College Station, Texas, to help you with Family Violence allegations in the marriage.

Child Custody & SUpport
In every divorce with Children, child custody will be an issue. It is important to select an experienced child custody lawyer that will fight for the best possible possession schedule in the Divorce because it will be much more difficult to modify a custody order later. What possession schedule is right for your children? Is it the Standard Possession Schedule, a 50/50, or some other unique schedule. Regardless of the unique circumstances in your child custody case, our Divorce Lawyers in Montgomery, Harris, Grimes, Waller, Walker, Brazos, Washington & Surrounding Counties are ready to help you succeed. Schedule a Free Consultation and ask about payment plans.
Protective Orders
Sometimes Family Violence is a paramount concern in a divorce proceeding. Domestic Abuse allegations are frequently thrown out, and this is normally because a Family Violence finding by a Texas Court will prevent the violent spouse from having a Joint Managing Conservatorship status with their children. One of the best tools available under the Family Code is a Protective Order that will keep the offending parent away from the other parent, the children, and even require them to not possess a fire arm while the order is in effect. Our Divorce Lawyers at Nick Davis Law have frequently pursued and defended against protective orders. If a protective order or family violence allegations are a theme in your divorce, contact our experienced divorce lawyers to help develop a winning strategy.

Is your Divorce Contested?
While it would be great if all divorces could be fast, affordable, and uncontested, the problem is, not all spouses can work through the complex problems that are common in any marriage. It’s nearly impossible to completely remove emotion from the divorce process. A divorce, next to the death of a loved one, is probably the most stressful event that can occur in a person’s life. This also applies to the children. This is why it’s important to hire an experienced Conroe | The Woodlands Divorce Lawyer you can trust and who will help you take a step back and try to look at the conflict objectively and rationally because when it’s your divorce, it’s hard to know when you are not thinking correctly. You don’t want to spend the money on a contested divorce if it’s not necessary or practical. But at the same time, you don’t want to get taken advantage of either and agree to something that is grossly unfair.
The reasons for the divorce can vary and for some, it’s not enough to just say “no one was at fault, we just grew a part.” Many people for religious reasons or otherwise don’t want it to appear that they “gave up” on their marriage and for them a fault based reason for divorce is necessary to obtain closure and move forward in life.
For others, a straight forward 50/50 division of asset divorce is not fair for many complex reasons. Perhaps the earning potential of spouses are vastly different, or one spouse is older, disabled, or otherwise lacks financial security. Moreover, what about a spouse that wasted large sums of money on gambling, drugs, bad business decisions, or affairs? Is it fair that the wrongdoing spouse be permitted to walk away with 50% of the assets?
Whatever the circumstances are in your marriage that are preventing you from pursuing an uncontested divorce, The Woodlands | Conroe Divorce Lawyers in our office can help you. Contact an Experienced Divorce Lawyer for a Free Case Evaluation.
FAQ
Frequently Asked Questions
Pay Child Support without being ordered to do so.
One of the our favorite areas of cross examination to use against a father when we are representing the other parent is the fact that a father wants primary custody or a 50/50 possession schedule, yet they wouldn’t voluntarily pay to support the child. Even better, if the child is a baby and the Father won’t even buy diapers or formula. If you are a father and you want a chance in court, there is absolutely no excuse for failing to pay something in child support or to help with groceries and supplies. Judges hate this, especially Judges that have children of their own or who were once Family Law Attorneys. The child support paid doesn’t have to be 100% in line with the child support guidelines, but something better be paid without a court requiring a father to pay if that father wants any credibility in court. This is obvious and easy for a father to do and it makes a father look good to the judge, especially since that same judge probably hears countless child support cases where a deadbeat father won’t do anything voluntarily to financially support their child.
Ask to See Your Child Often.
When a father comes into court asking for primary custody or a 50/50 split and they cannot show a consistent pattern of interaction with the child or at least showing they’ve tried to visit and have possessions, they will lose their case. An uninvolved father doesn’t stand a chance against a mother in family court unless there are some terrible bad facts to use against the mother. If a father can show that they are ready and willing to be involved with the child they may get some favorable treatment from the judge, especially if an experienced Fathers’ Rights Lawyer is able to make the mother look selfish and spiteful but denying the father possession and access without a good justification. moreover, a Father should always keep in mind that success in their case may require “playing the long game.” In that, if a Father wants primary custody, success in the original custody case may be getting the Extended Standard Possession Schedule or a 50/50 Split. Then it will become even easier to request more time in future cases and chip away at the mother’s advantages in a child custody case.
Always remember, you will probably ask for time with your child and be denied. While that is not good for you or the child, it can help your custody case. Make sure you follow up on your oral requests with written requests through text, email or other communication methods and save the message.

Go to your Child's Activities.
Doctors appointments, meet the teachers, holiday performances, extra curricular practices and events, whatever your child has going on in their lives make sure you participate. Take them to practices without complaining, and attend every event and performance without fail unless it’s not feasible for your job. Whatever sacrifices you have to make to be apart of your child’s life, do it if you truly want more time with your child. Additionally, never use the excuse of “well their mother wouldn’t tell me when the practice was or where the game was.” You know what will sound better in court? A man that testifies that the mother would never tell him about practices or the locations but they went the extra mile and found out through other sources in order to make sure they attended. Testimony like that makes a father sound dependable and serious, and even better, (as far as evidence to use in court to win a custody case) it makes the mother sound like a terrible person and not someone that can be trusted to act in the best interest of the child. Always reach out to the other parent and ask about appointments and events so you can attend. When you go, make sure you never get into a conflict with the mother and, if possible, don’t bring your significant other to the event if this is an Original Suit Affecting the Parent Child Relationship. Not that bringing someone is terrible, but it just removes one distracting element from your case. If the child’s parent won’t respond to your requests or is evasive, save the communications.

Don't do Drugs.
This shouldn’t require much explanation. Even if you are going to a state like Colorado that allows the use of marijuana, don’t do it right now. Some judges are very conservative especially in counties like Montgomery, Grimes, Waller, Walker, Brazos, and Washington. Just don’t do it.
Always be cordial to the other parent and offer to help whenever possible.
In any child custody case, a parent is going to lose their temper. It will happen. However, when you are a father trying to win a custody case, you can’t afford to lose your temper too often, and if possible, never do it in writing. Inflammatory text messages and emails are regularly admitted as evidence in court and if these messages are frequent or considered harassing or abusive, it can kill a fathers’ case. Do your best to appear cordial, friendly, reasonable, and helpful if possible. If your spouse needs a babysitter, always volunteer and even drive to pick up the child. Things like this will go a long way.
