What is separate Property?

Separate property is property that was acquired or created apart from the marriage.  In a divorce suit, a Texas Court is prohibited from dividing one parties separate property.  Typically, separate property is one or more of the following:

1) Property Acquired before the Marriage.

2) Property Acquired by devise or descent.  This normally is an inheritance.

3) A Gift from a Third Party

4) A Gift from a Spouse and any income arising from that gift.

5) Property recovered from Personal Injury cases including bodily injury, mental anguish, and pain and suffering.  However, lost wages and loss of earning capacity is considered community property.

6) Property Acquired by an Agreement. This comes from Premarital Agreements and other Marital Property Agreements.

7) Property Acquired While Living in Another State is separate property to the extent it would have been considered separate property had it been acquired while living in Texas.  This is often referred to as Quasi-Separate Property.

8) Property Acquired in exchange for Separate Property or Separate Property Funds.  For instance, a spouse inherits $50,000 and they use that money to buy a boat.  The boat is then separate property.

9) Property Acquired on Separate Credit.

What is the community Estate?

Simply put, the community estate is everything that isn’t Separate Property.  The presumption in Texas is, if the property was acquired during the marriage, it is community property unless proved to be separate by Clear and Convincing Evidence.
