You Probably Didn’t Know You are a Lien Holder for Unpaid Child Support

I bet you didn’t know you are a lien holder, did you?  Every month in which your Ex doesn’t pay child support, a child support judgment arises as a matter of law and you are authorized under the Texas Family Code to file a Child Support Lien.

Child Support Liens are extremely useful and attach to all property except a homestead.  “All property” includes things like Social Security Benefits, Current Wages, Bank Accounts, Retirement Funds, Stocks, Business Interests, Personal Injury claims, Lawsuit Claims, Cars, Boats, Vacation Homes, and the list goes on and on.

Used effectively the child support lien can bring an element of surprise to your case by not only knocking your ex off their feet but also by freezing as much money and property as possible before they can dispose of it when they find out a lawsuit to enforce child support is pending in some Texas Court.

Here is the scenario I like to use.  First, the Child Support Enforcement Lawyers at Nick Davis Law obtain all the necessary information from our client and then our Child Support Attorneys research the nonpaying parent.  Next, our Child Support Lawyers get all the necessary motions and documents prepared and ready to go, and, before filing anything, we file a child support lien on every financial institution possible and then within a matter of days file all the necessary court documents to enforce your child support. Then, we wait for about a week to have your ex served. 

You see, if everything goes smoothly, your ex will be going about their daily routine until they try to run their debt card, or withdrawal money from a bank account.  Or, better yet, they will deposit money into a frozen bank account and then to their surprise they will discovery they can’t access their money anymore.  Hopefully by the time they learn this, they will receive a stack of papers in the mailing showing them how bad this situation has become.  And, with all their funds frozen, they will have any even harder time retaining an attorney fight the case.  This all becomes even better if the nonpaying parent is married, because at that point, not only will they be getting grief from the lawsuit, but you can rest assured, they will be getting an ear full of complaints from their spouse at home.
